Dear Neighbors:

Happy New Year!  I hope that you are all happy and healthy at the end of this very challenging year.  It’s been a difficult year for all of us, including myself, but I am very grateful that my family and friends have all stayed well, and I’m also very glad to live in such a beautiful place as Puerto Vallarta.  We’re fortunate that we are able to spend most of our time here in the fresh air, and to live our lives with more freedom than those in colder climates who are forced to be inside.

In the last Newsletter I listed many of the things that CCHA has accomplished this year.  This month I want to write about the revenue that is required to keep Conchas Chinas running smoothly for an entire year.  

Also, I want to make an apology.  As much as we’ve tried this year to keep everything in really good condition, I’m disappointed that the roads have again fallen into disrepair.  During the spring and summer, we had all of the serious potholes fixed; but, as happens every year, at the end of the rainy season we have new potholes to deal with.  I would like to have had a crew out working on the roads for the past two months—when most of the newest potholes developed; but dues payments had gone from a dribble to a complete standstill, and we are now out of money.  With this newsletter we begin our Fundraising Drive for 2021, and as soon as we begin receiving dues payments again, we will begin the road work again.

I want to sincerely thank all of you who have supported CCHA during 2020, through your annual dues payments, and through additional donations.  We have been able to get a lot done, thanks to your contributions!  As we go into 2021, I am optimistic about the COVID vaccine, and about our lives getting back to a version of normal.  I’m also optimistic about the future of Conchas Chinas and CCHA.  We had to postpone many of the events that we had planned this year, but hopefully we can get back on track in 2021 and make our neighborhood better than it has ever been.

We are planning our Annual Assembly in March, and I’ll keep you updated about that.  We will see what the Covid situation is in March, and can modify the assembly and how it is presented if necessary.  We would very much appreciate getting 2021 annual CCHA dues payments in as soon as possible so that we can keep things running smoothly during January and February, and begin the projects that need to be accomplished as quickly as possible.  You will be receiving a dues statement soon, and we have made the payment options easier than ever.  You can pay through our new website, or there are other options available on the dues statement.

A Message From CCHA Vice President Dan Custer:

I wanted to give you and update on our campaign against illegal building and development in the area.  Our attorney has filed complaints against illegal projects (those already built, as well as those proposed and in-process) in Conchas Chinas, but also against the Condo Serena project which is in Amapas, since this project affects Conchas Chinas. 

 

The Serena project has been closed by federal authorities through our actions at the federal level.  The good news for our community is that the local authorities have now been put “on watch” by federal enforcement agencies (PROFEPA, SEMARNAT AND SEDATU) and will need to think twice before approving developments that violate our zoning laws.  Serena developers have the right to contest the closure, but the judge will need to determine what prompted the closure in the first place (which was a violation of District 9 zoning and failure to perform an environmental impact report).  Even if Serena gets a decision to proceed with construction, they will be forced to scale back the size and scope of the project in order to comply with the zoning laws.

 

Our efforts thus far have been accomplished by using federal oversight agencies, thereby preventing the costly use of “amparos” through private attorneys.

 

Regarding the proposed Carmelina Residences in Lower Conchas Chinas, we quickly organized a protest upon seeing the demolition crews arrive at Casa Carmelina, and enlisted the local media to cover our “manifestation”.  Susana Carreno of the local radio show “Todas las Voces Cuentan”, as well as “La Tribuna” and “Vallarta Opina” attended this demonstration.  Our attorney has filed formal denuncias (complaints) with the federal authorities with respect to Carmelina.  With our persistence, the federal authorities have opened investigations into local officials who approved the omission of an Environmental Impact Study prior to receiving a permit.

 

Additionally, regarding the proposed change in zoning of our area to “Turistico”, we have filed a grievance with the SNA (Sistema Nacional Anticorrupcion).  This proposed change is illegal and our attorney will be able to inform council members through local media that it is not prudent to vote for such a change to the existing zoning laws.

 

Regarding the illegal sale of the Green Zone (Area Verde) in Conchas China, we have filed a denuncia with SNA, and the City of Puerto Vallarta has subsequently denied a request for a building permit. 

 

Although the fight to protect our community from illegal development is far from over, we have made significant strides in their prevention to date.  We are accomplishing all of these legal efforts through private donations from homeowners to the CCHA Legal Fund, rather than using any money from CCHA membership dues.  These legal battles are an ongoing effort, and must be funded in order to be successful.  Your financial help with this will be very appreciated and instrumental in this fight.  Donations can be made through the “Make A Donation” option on our website, www.conchaschinaspv.com.

 

Thanks to Past Board Members and Volunteers

As I’ve mentioned, our board has had a lot of work to do this year, but we also received a great deal of help, support, and guidance from some of the previous CCHA Board Members and Volunteers.  We couldn’t have made the transition without their expertise and encouragement.

 

I of course thank Tari Bowman for all of the years that she put into leading CCHA.  I also want to especially thank Joni Henry, Don Sullivan, and John and Janet Cotton. 

 

Joni led the membership effort for many years, and was a great help to Jon Bonsignore, Marisol Carranza and me this year in cultivating new members.  Joni is familiar with almost every home in Conchas Chinas, and she continues to help us as a consultant, and through personal donations.

 

Don Sullivan oversaw the gardening and maintenance staff for the past few years.  He not only supervised, but frequently helped the guys with the gardening and cleanup.  He did a great job of making sure that any maintenance issues were resolved quickly, and he continues his help through ongoing financial contributions.

 

John and Janet Cotton served on the CCHA board for many years, and I’m very appreciative of they work that they did.  John acted as CCHA Treasurer, and both he and Janet were very instrumental in keeping CCHA running efficiently for a number of years.  They are also major donors to CCHA, and I am very thankful for all of their support.

 

I thank all of these great neighbors for their help and support, and for their confidence in this new board.  They have all been exemplary leaders of Conchas Chinas in the past, and continue to help us with whatever we ask of them.
